[12/16/11] MOTION FILED TO APPROVE INTERIM DISTRIBUTIONS AND FOR RELATED PROCEDURES

On January 17, 2011, at 10:00 a.m., the court will consider the Receiver’s motion to do the following things. A copy of the motion and the exhibits thereto can be found at the Pending Motions section and has been mailed to all claimants. This description does not supersede the Motion or the Notice of the Motion. The Motion seeks to (1) set distribution priorities, including paying investors ahead of other pre-receivership creditors, (2) approve claims and identify disputed claims; (3) establish a procedure for resolving disputed claims; (4) reserve funds to partially provide for unpaid administrative expenses and taxes; and (5) allow the Receiver to use or reserve $5,100,000 for an interim distribution on approved investor claims. Please review that document. If you are an investor, please review Exhibit “4.” Next to the claimant’s name will be the amount of the claim and other information and, in columns 6 and 7 are listed the amounts of the claim and the amounts of disputed portions, if any, and your claim.
